A MAN accused of trafficking drugs at Lexton's Rainbow Serpent music festival will face a contested hearing next year.
Carrick Dalton, 25, refused to accept a one-month jail sentence, followed by a community corrections order, at the Ballarat Magistrates Court in May.
He re-appeared on Wednesday for a special mention but his barrister, Brett O'Sullivan, said the case had not resolved.
The prosecution have said they would not withdraw the charge of trafficking ketamine.
Mr O'Sullivan told the court he was seeking an expert opinion in the matter and for the drugs to be appropriately weighed and examined by forensic scientists.
This can not be done until the case is booked in for a contested hearing.
Dalton faces six drug-related offences, including trafficking ketamine and possessing ecstasy and GHB.
Police previously told the court Dalton was located unconscious at the Rainbow Serpent Festival in January due to an overdose of the drug ketamine.
Medical staff took Dalton to a medical facility, where police allegedly located a number of small deal bags inside a 'bum bag' draped over his shoulder.
Police officers attended and a search revealed the accused was allegedly carrying two small deal bags containing ketamine, 10 green pills suspected to be ecstasy, two bottles of liquid believed to contain GHB and $1415 cash.
Dalton, of New South Wales, will return to court in December for a special mention, followed by a contested hearing in January.
His bail was extended, with conditions including a surety, curfew, not to use drugs, reporting to police three times a week and to live at a stable address.
