The project is on hold after it was revealed VicRoads failed to renew planning permits for the 12km stretch between Buangor and Ararat.
Three plaintiffs, including Ararat landowner MairiAnne Mackenzie, launched legal action in the Supreme Court in October last year.
They argue a less expensive and quicker to construct duplication could be completed north of the alignment chosen by VicRoads.
Michael Kennedy, who is representing the plaintiffs in the court action, said it was unclear how the planning permit failure would affect their case to have the alignment moved.
“I think we will have to be reactive because VicRoads will have to make the first submission,” he said.
