Amendment for Pomonal rural living zone change

ARARAT - Ararat Rural City Council has agreed to approach the Minister for Planning to authorise council to prepare and exhibit amendment C20 to the Ararat Planning Scheme to rezone land at Pomonal from farming zone to rural living zone.

Eco Synergy Planning and Design on behalf of Mr Yildiz has approached Council to undertake an amendment to the Ararat Planning Scheme to rezone land at 137 Church Road Pomonal from Farming Zone to Rural Living Zone.

The subject land is approximately 18.84 hectares in area and is located on Church Road immediately adjacent to the Rural Living zoned land to the west of Pomonal. It is currently zoned Farming Zone with a Significant Landscape Overlay, a Vegetation Protection Overlay and a Wildfire Management Overlay. It is lightly vegetated with mainly mature Wattle trees with little or no under storey but with established pasture.

Rural land that is to be rezoned from Farming Zone to Rural Living zone must meet all requirements of Minister's Direction No 6.

The requirements of the Direction are that the amendment:

Is consistent with the housing needs and settlement strategy of the area.

Is supported by and supports sustainable and viable settlements and communities.

Does not compromise the sustainable future use of existing natural resources including productive agricultural land, water and mineral and energy resources.

Protects existing visual and environmental qualities of the area, such as landscape, water quality, native vegetation, habitat and biodiversity.

Can efficiently be serviced by social and physical infrastructure, at an acceptable and sustainable community cost.

The proponent sought the views of relevant agencies and officers indicated that that given there were no major objections from appropriate authorities that the preparation and exhibition of an amendment was warranted.

The amendment was supported by the Ararat C14 Panel report where the Panel concluded the land at 137 Church Road should be within the Pomonal Township Framework Plan. If the site was included in the Rural Living Zone at 8ha minimum lot size; and recommended the land at 137 Church Road should be within the Pomonal Township Framework Plan and that the minimum lot size should be 8 ha.

The rezoning request was of minimal impact in creating only one additional lot.

Cr John Cunningham said the report made it apparent that the owner thought that when he was being presented to the C14 panel that this would indeed be the outcome from the C14 panel.

"The C14 panel report concluded that the land at 137 church road Pomonal should be within the Pomonal township framework plan if the site was included in the the rural living zone at eight hectare minimum lot size," he said.

"The Panel also recommended that land should be within the township framework plan and that the minimum lot size should be eight hectares. Why isn't it in there?

"It was not included in the documentation that council put forward, I don't know why it isn't in there, but what this recommendation seeks to do fix up an error in leaving this area out of the C14 resolution to the planning at Pomonal."

Ararat Rural City Council resolved to formally approach the Minister for Planning, the Honourable Mathew Guy, to authorise Ararat Rural City Council to prepare and exhibit amendment C20 to the Ararat Planning Scheme to rezone land at 137 Church Road, Pomonal from Farming Zone to Rural Living Zone.
